Deferred Action for Childhood Arrivals (DACA)
Background
In June 2012, the Department of Homeland Security announced a program known as Deferred Action for Childhood Arrivals (DACA) to protect individuals who entered the United States as young children.
Eligibility
You can apply for DACA if:
- You entered the United States before the age of 16;
- Have continuously lived in the United States since January 1, 2010;
- Were present in the United States on November 20, 2014;
- Either graduated or obtain a certificate that you completed high school, have obtained a general education development (GED) certificate, or currently in school at the time you submit your application; and
- Not convicted of certain criminal offenses.
If you do not think you meet all of these requirements you may be eligible for a waiver to forgive a crime on your record. Our law firm will assist you in gathering the necessary evidence to prove that you are eligible for DACA. Give us a call to better understand your eligibility.
Procedure
Even if you find yourself in removal proceedings you will still be eligible for DACA. If you are in removal proceedings we will help you file your DACA application with the United States Citizenship and Immigration Services unless you are in immigration detention. We will do everything we can to have your case administratively closed so that we can have time to get your DACA application approved.
Our law firm will work with you and give you examples of different types of evidence the government will use to consider whether you meet the eligibility requirements for DACA.
We have experience in winning tough DACA cases where other law firms and attorneys had thought the client would never have their application approved. Call us for a consultation to learn whether you are eligible and how we might be able to have your application approved as well!
Benefits
If you are granted DACA you will be entitled to many benefits including being able to:
- Legally reside in the United States for a renewable period of 3 years;
- Legally work in the United States for a renewable period of 3 years;
- Travel within the United States; and
- Apply and obtain a social security number.
